Terms and Conditions

OVERVIEW

These Terms and Conditions are between Called to Help Others, LLC (hereinafter “CTHO”) and the User (“user”, “you”, “your”).  These Terms and Conditions (“Terms”) apply to CTHO’s website available at https://calledtohelpothers.com/ and, any other website or mobile application to which these Terms are attached (collectively the “Sites”).

By visiting our Sites, you voluntarily agree to these contractual terms and agree that you have read, understand, and fully consent to be bound by the following Terms, the Privacy Policy, and any additional Terms and conditions that may apply to specific sections of the Sites or to the services available through the Sites or from CTHO. You agree that by using these Sites, you are an adult and you are legally able to enter into a contract.  If you do not agree with or accept any part of these Terms, you must not use this Site.

You can review the most current version of the Terms at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our Sites. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Sites following the posting of any changes constitutes acceptance of those changes. Accessing the Sites, in any manner constitutes use of the Sites and your agreement to be bound by these Terms.

SECTION 1 – FOR EDUCATIONAL AND INFORMATION PURPOSES ONLY

The purpose of the Sites is for educational and informational purposes only. The Sites are not, nor is it intended to be, providing professional medical, mental health or coaching advice.  By using the Sites, the user acknowledges and agrees that the Sites and all the materials available on the Sites constitute CTHO’s intellectual property, and is owned solely and exclusively by CTHO. The User further agrees that all intellectual property may not be modified, copied, reproduced, republished, uploaded, posted, transmitted sold or distributed in any manner.  The user may however download and/or print one copy of an individual page of the Site for your personal, non-commercial use.

 

SECTION 3 – ASSUMPTION OF RISK

 You acknowledge that you are voluntarily participating in using our Sites, and you alone are solely and personally responsible for your results. You accept full responsibility for the consequences of your use of any information provided by us through any means whatsoever. Your use of this information is at your own risk, and you absolve us of any liability or loss that you may incur from your use of the information provided.

 

SECTION 4 – NO WARRANTIES OR GUARANTEES OF ANY KIND

 CTHO does not guarantee that you will achieve a certain result. You accept and understand that results differ for each individual and circumstance. Information provided through the Sites is provided “as is,” without warranty of any kind. To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. By using our Sites, you are using your own judgment and fully and completely hold harmless, indemnify, and release us from any and all liability, damages, causes of action, allegations, suits, claims, and demands whatsoever, in law or equity, arising from your participation in or in any way related to our Sites.

 

SECTION 5 – GOVERNING LAW

 These Terms shall be governed by the laws of the State of Texas and any dispute resolution process and/or suit filed under these Terms shall be subject to the exclusive venue and jurisdiction of Lubbock County, Texas, or, if the subject of any dispute is controlled by federal law, any appropriate federal court in the State of Texas. If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

 

SECTION 6 - THIRD-PARTY LINKS

Third-party links on the sites may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

SECTION 7 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request, you send submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
